After the housing is first registered, a real estate development enterprise prepares an existing housing sales plan and applies to the housing, urban and rural construction department of the district where the house is located for an existing house sales record. At the same time, the “Implementation Opinions” make it clear that the right to use the houses and construction land sold should be unsecured or sealed. In the process of selling existing homes, the “Implementation Opinions” stipulate that real estate development enterprises can sign a deposit contract with the buyer after obtaining a construction permit, and generally charge a deposit of no more than 1% of the total housing price. If a real estate development enterprise breaches the contract and is unable to deliver the house on time, the buyer has the right to cancel the deposit contract in accordance with the contract agreement.
