In order to effectively resolve the issue of the joint application of the old and new laws after the implementation of the Ecological Environment Code and ensure the full and accurate implementation of the Code, the Supreme People's Court issued a number of regulations on the time effect of applying the “Ecological Environment Code of the People's Republic of China” on August 6. This is the first supporting judicial interpretation of the Ecological Environment Code. It will be implemented simultaneously with the Code on August 15. According to reports, there are 13 articles in the regulations, which strictly follow the principle of non-retroactivity of the law and the rules of favorable retroactivity and exceptions as stipulated in section 104 of the Legislative Law. They clarify the general standards and specific rules applied by the People's Court to adjudicate ecological and environmental cases in conjunction with old and new laws after the implementation of the Ecological Environment Code, and provide clear adjudication guidelines for ecological and environmental judicial practice.
